Terms & Conditions

TERMS: Net 30 days from date of shipment. 1 1/2% interest charge per month over 30 days. For customers who have not established credit with us, a cash down payment of 30% is required with the order and the balance due 28 days prior to shipment.

CLAIMS: Claims for damage, shortage or any other immediately recognizable reason must be made directly to us upon delivery by telephone (800-557-5522) or fax (931-934-2844). NO CLAIMS WILL BE CONSIDERED ON MATERIAL ON INVOICES THAT ARE PAST DUE UNTIL ALL PAST DUE INVOICES ARE PAID IN FULL. Plant material must be mulched-in upon arrival. NO EXCEPTIONS.

CONDITIONS OF SALE: We are careful to keep varieties true to name. We give no warranty, expressed or implied, as to the growth or productivity. It is mutually agreed that our liability for any errors or other causes is confined to free replacement or refund of purchase price. All orders are accepted subject to prior sale of stock and crop conditions. Orders shall be void should injury be caused beyond our control. Orders are accepted with liability for non-performance if labor shortages, delay in transportation or shortage beyond our control should prevent us from making delivery. Buyers agree that any dispute arising out of the sale of these goods shall be arbitrated in the Chancery Court for Warren County, Tennessee and the State of Tennessee shall be the forum for any and all litigation that may arise from any sale of goods by the seller. Either party not prevailing in such action shall be liable to the prevailing party for reasonable attorney fees.

CANCELLATIONS: Any cancellations must be made in writing and received by us prior to January 1st.

TRANSPORTATION: When stock is turned over to the carrier for shipment our responsibility ends. All stock travels at the purchaser’s risk. If a shipment is damaged upon arrival, secure proper notation on freight bill and file a claim with carrier. All delivery charges are C.O.D. and must be paid when stock is delivered.

INSPECTION: Our nursery stock has been inspected by our State Department of Agriculture.

LOCATION: Our nursery is located at 11046 Smithville Highway on Hwy. 56 north between McMinnville and Smithville. Visitors are welcome. February and March visits require an appointment and should be avoided if possible.
